1. Service and eligibility
Next Level Pixel provides website-visitor identification, contact-resolution, pixel-management, export, and related workflow tools. Resolution depends on data availability and third-party matching. Not every visitor will be identified, and available fields may be incomplete, outdated, or inaccurate.
You must be at least 18 years old, have authority to bind the business associated with the account, and provide accurate account and billing information.
2. Beta plan, trial, and billing
The beta plan includes a 30-day free trial followed by a recurring charge of $97 per month, unless canceled before the trial ends. A payment method is required to begin the trial. The plan includes up to 1,000 resolved contacts per account in each monthly usage period.
Fees are charged in advance and are non-refundable except where required by law. You may cancel through the billing portal. Cancellation takes effect at the end of the current billing or trial period. Taxes, if applicable, are your responsibility.
Accounts requiring higher volume, multiple business units, or custom terms may be moved to a separately negotiated plan only after written agreement.
3. Your compliance responsibilities
You are responsible for your websites, notices, consent mechanisms, cookie banners, privacy disclosures, suppression lists, outreach, and all use of resolved data. You must determine which federal, state, local, and industry-specific laws apply to you, including privacy, telemarketing, text messaging, email, advertising, and consumer-protection requirements.
Next Level does not provide legal advice and does not represent that use of the service is lawful for every business, location, audience, or outreach method. You must obtain independent legal guidance where appropriate.
4. Acceptable use
You must follow the Acceptable Use Policy. You may not use the service to harass, discriminate, stalk, threaten, deceive, exploit, or unlawfully profile any person; to contact people without legally required consent; or to sell, publish, expose, or misuse personal information.
5. Accounts and security
You are responsible for account credentials, authorized users, installations, exports, integrations, and activity under your account. Notify us promptly of suspected unauthorized access. We may suspend access to protect the service, affected individuals, or other customers.
6. Third-party services and data
The service depends on hosting, payment, identity-resolution, analytics, and other third-party providers. Their availability, coverage, and terms may change. We may replace providers or modify the service when reasonably necessary.
7. No guarantees
The service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Next Level disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, match rate, deliverability, revenue, leads, customers, or results.
8. Limitation of liability
To the maximum extent permitted by law, Next Level will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, data, goodwill, or opportunities; or claims arising from your outreach, disclosures, compliance decisions, or misuse of resolved data.
Next Level’s aggregate liability arising from the service will not exceed the amount you paid for the service during the three months before the event giving rise to the claim.
9. Indemnification
You agree to defend, indemnify, and hold harmless Next Level and its personnel from claims, losses, penalties, costs, and reasonable legal fees arising from your websites, notices, outreach, data use, violation of law, violation of these Terms, or infringement of another person’s rights.
10. Suspension, termination, and changes
We may suspend or terminate access for nonpayment, security risk, unlawful conduct, policy violations, abuse, or material risk to the service or others. We may update these Terms by posting a revised version and, for material changes, providing reasonable notice.
11. Disputes and general terms
These Terms are governed by applicable United States law and the law of the state in which Next Level is organized, without regard to conflict-of-law rules. If any provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver.
